Action by plaintiff LeRoy Beck against defendants Walter Hamann and Hardware Mutual Casualty Company for damages arising out
of injuries received when plaintiff was struck by a truck operated by Hamann. Defendants' motion for summary judgment dismissing
the complaint was granted by the trial court, and plaintiff appeals. On January 29, 1947 plaintiff was an employee of the defendant Hamann, a contract motor carrier. A Sterling truck owned by
defendant had become stalled, facing west, on West Hampton Road west of North Teutonia Avenue in the city of Milwaukee. A
Mack truck also owned by defendant was placed, facing east, so that the rear of the two vehicles stood three to four feet
apart. The complaint states that roadway and driving conditions were extremely dangerous and uncertain by reason of ice, snow
and wind. Plaintiff alleges that operation of the trucks was under the control of the defendant Hamann, who directed plaintiff
to go between the trucks and attach a chain between them, and that while defendant was thus engaged Hamann 'deliberately,
wantonly, wilfully, intentionally, in impatient anger, and in utter, reckless and wanton disregard of the consequences and
of the presence, rights and safety of plaintiff,' set the Mack truck in motion backward, crushing the plaintiff between the
two trucks and causing the injuries described in the complaint.
